Thomas More Society: Federal Court Grants Temporary Restraining Order Against New York in Healthcare Worker Vaccine Mandate Lawsuit

The United States District Court for the Northern District of New York has granted a Temporary Restraining Order against the governor of New York and her administration at the request of a group of New York medical workers in Dr. A, et al. v. Kathy Hochul, et al. on September 14, 2021. The seventeen health professionals, including doctors and nurses, are suing the state of New York for violating their Title VII and Constitutional rights with the Covid-19 vaccination mandate while disallowing religious exemptions.

By order of federal Judge David Hurd, the state has until September 22, 2021, to respond. If the governor’s legal team opposes the TRO conversion to a preliminary injunction, the defense attorneys will need to show cause during an in-person oral argument at 10 a.m. (Eastern) on September 28, 2021, at the United States Courthouse in Utica, New York.
